Terms and conditions 　 　 Lucky Draw and Draw Date: 　 “Win a Trip to Asia – Free Air Ticket Lucky Draw” is organized by Silicon Power head office running from now to 31 December 2008. 　 Winners will be decided on every 5th of respective next month from the lucky draw entries registered during the above-mentioned period at the Silicon Power head office, situated at 7F, No. 106, Zhou-Z. St., NeiHu, Taipei, Taiwan (or such other venue as may be determined and announced by Silicon Power head office). Participants 　 The Lucky Draw is opened to all consumers who make purchase of Silicon Power products during the activity period. Participants must be aged at least 18 before the end 31 December 2008. 　 Employees of Silicon Power and their respective immediate family members are not eligible to enter the Lucky Draw. Entry Requirements 　 Participants can register Lucky Draw entries at the activity website (http://www.silicon-power.com/eng/event/070501AsiaTrip/) by entering the information including personal full name, reachable contact address, phone numbers and e-mail address, purchase date, purchased product name and specifications, location of purchase. The cut-off date and time for registration is 31 December 2008. Announcement of Results 　 Results of the Lucky Draw will be posted on the activity website and the winner list of the respective month will be announced the next 10th. (http://www.silicon-power.com/eng/event/070501AsiaTrip/) 　 Lucky draw winners will be notified by phone and e-mail from Silicon Power head office no later than February 5, 2009. Prize Redemption 　 Winners must complete the procedure of prize redemption within one month after the notification been sent, winners failing to contact Silicon Power head office will forfeit their prizes. 　 To claim a prize, a winner must present his / her corresponding information for flight ticket issue. General Terms & Conditions 　 Silicon Power has entrusted Peace Tour Co., Ltd as our ticket agent in terms of purchasing air tickets to be given to winners. 　 By entering into the Lucky Draw, participants accept and agree to be bound by the Lucky Draw terms and conditions and the terms and conditions attached to the prizes as well as the Privacy Policy and Personal Information Collection Statement set out in Silicon Power official website. 　 Silicon Power reserves the right to withhold the prize or reclaim the prize if awarded, and award or dispose of it in such manner and to such person as Silicon Power deems fit if the winner is subsequently disqualified or is found not to be entitled to participate in the Lucky Draw. 　 Without prejudice to the other provisions herein contained, a winner's entitlement to claim his / her prize will be forfeited if he / she fails to present the information for flight ticket redemption or to redeem or claim his / her prize in accordance with these terms and conditions. 　 Winners will win the air ticket valid for limited days agreed by Silicon Power. Winners should follow the regulations, including seat booking, set out by the designated airline companies. Winners must use the ticket within the limitation and Silicon Power will not be responsible for paying the price difference due to over the limitation. 　 Winners who fail to redeem or claim their prizes before the deadline designated by Silicon Power will be considered as having given up their right to redeem or claim their prizes. 　 According to the TAX LAW governed by the government of Republic of China, all prize winners will have to tax 15% of the amount of their winning prizes (20% for residents outside of R.O.C and not holding nationality of R.O.C). For winning prizes amounted under 2,000 NTD and is of ROC residence won’t be taxed. 　 Any winner, whose prize (or prize entitlement) has been forfeited, is not entitled to any payment or compensation from Silicon Power. Silicon Power reserves the right to award or dispose of the forfeited prizes in such manner and to such person as it deems fit. 　 Winners are responsible for arranging for delivery and insurance of their own prizes and all taxes, charges and fees in relation thereto. 　 For winners who are not holding ROC nationality must send by registered post or send by fax their proof of identity in terms of claiming the prizes, winner who can not present themselves at Silicon Power headquarter must also wire 20% of the amount of their winning prizes to the bank account designated by Silicon Power to claim the prizes. 　 All prizes cannot be redeemed or exchanged for cash, credit or any other items from Silicon Power. Silicon Power is entitled to pay winners at the fixed amount of 500 USD as the reimbursement if any inevitable occasions occurred. 　 Silicon Power may, at its sole discretion and without consultation or reference to Lucky Draw participants, at any time substitute or replace any prize with any other prizes of equal or similar value at the choice of Silicon Power. 　 The decision of Silicon Power on all matters relating to, or in connection with, the Lucky Draw shall be final and binding on all parties concerned. 　 Any violation by the participants of these terms and conditions will result in disqualification of the relevant participants. 　 The copyright of the material, text, graphics, logos and images on any promotional materials of the Lucky Draw belong to Silicon Power solely and exclusively. The contents on the promotional materials of the Lucky Draw may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any other purposes not expressly permitted by Silicon Power head office. 　 All prizes and offers are subject to relevant legal requirements and restrictions. 　 The invalidity, illegality or unenforceability of any provision in these terms and conditions shall not affect the other provisions of these terms and conditions, which shall remain in full force and effect. 　 These terms and conditions shall be governed by the laws of Taiwan, and the Taiwan Courts shall have the exclusive jurisdiction to deal with all matters relating to these terms and conditions. Whoever makes the entries of this free air tickets campaign is obligated to acquire the knowledge of related laws governed by ROC government to safeguard and better understand his / her rights and obligations regarding the campaign. 　 These terms and conditions are written in English, Chinese, Hispanic, Russian and Japanese. In case of inconsistencies, the English version shall prevail. Disclaimer 　 Silicon Power reserves the right to suspend, amend or modify any of these terms and conditions, and any arrangements in connection with the Lucky Draw, and may withdraw or discontinue the Lucky Draw at any time at its sole discretion, and without prior notice or liability. 　 Silicon Power shall not be liable in any way to any person for any loss or damage (whether direct or otherwise) arising from or in connection with the Lucky Draw, including but not limited to any error or omission in conducting the draws, loss or destruction of Lucky Draw entries or other property or belonging, or any notice or correspondence which is misdirected, mislabeled, delayed or lost in the post or otherwise. 　 Silicon Power shall not be liable in any way to any person (whether by way of indemnity or contribution or otherwise) for any claim whatsoever arising from or in connection with the Lucky Draw whether for property damage, personal injury or death or of any other nature whether or not the same is caused by the act, omission or negligence of Silicon Power. 　 If for any reason, the computer system in whole or in part is not capable of running, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Silicon Power head office, which corrupt or affect the administration, secrecy, fairness, integrity or proper conduct of the Lucky Draw, Silicon Power reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and/or cancel, terminate, modify or suspend the Lucky Draw.
